These Terms and Conditions (“Terms”) govern your use of our website located at https://learningpursuits.com (the “Site”) and any related pages, Base44 apps/tools, forms, digital resources, coaching services, consulting services, group experiences, workshops, courses, or materials we provide (collectively, the “Services”).

By accessing or using the Site or Services, you agree to these Terms. If you do not agree, please do not use the Site or Services.

8) Coaching and Educational Disclaimer

Our Services are educational and informational in nature. Coaching is not therapy, and it does not replace professional medical, mental health, legal, or financial advice.

You remain responsible for your choices, actions, and results. We do not guarantee specific outcomes. Any testimonials or examples are not guarantees of results.

9) Purchases and Payments (if applicable)

If you purchase one-on-one coaching packages, group coaching packages, consulting, workshops, courses, or digital resources:

• - the description of what you are purchasing will be shown at checkout or in a separate written agreement

• - pricing and payment terms will be provided before you buy

• - any refund policy (if offered) will be clearly stated at the time of purchase or in the applicable agreement

Refund eligibility, if offered, will vary by offer and will be presented clearly at checkout or in the applicable agreement.

If no refund policy is provided for a specific offer, purchases are non-refundable unless required by law.

10) Scheduling, Attendance, and Participation (for coaching and group experiences)

If you enroll in coaching or a group experience, you are responsible for:

• - showing up on time for scheduled sessions

• - bringing your questions and participation in good faith

• - maintaining respectful communication in any group setting

We may establish or update specific participation guidelines for group coaching experiences to protect a safe and productive environment.

11) User Content (Forms, Submissions, Tool Inputs)

If you submit information through forms, tools, or message features (“User Content”), you confirm that:

• - you have the right to submit it

• - it does not violate anyone else’s rights or any laws

You grant Learning Pursuits a non-exclusive, worldwide, royalty-free license to use your User Content only as needed to operate, provide, and improve the Services (for example, to generate outputs you request, respond to you, maintain records, and support the experience).

12) Comments or Community Features (if enabled)

If the Site allows users to post comments or other public content, you agree not to post content that is unlawful, defamatory, abusive, obscene, misleading, or invasive of privacy, and not to post content that infringes the rights of others.

We may monitor and remove user content that we consider inappropriate or that violates these Terms. User comments reflect the views of the person posting them, not Learning Pursuits.

If a court finds we are liable for any reason, our total liability will not exceed the amount you paid us for the relevant Services in the 12 months before the event giving rise to the claim, or $100 if you have not paid us anything, whichever is greater.

Nothing in these Terms limits liability that cannot be limited under applicable law (including liability for fraud or willful misconduct).

18) Indemnification

You agree to indemnify and hold harmless Learning Pursuits from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your violation of these Terms, or your User Content.

We may suspend or terminate access to the Site or Services if we believe you have violated these Terms or misused the Services.

20) Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
